Consent to care
Valid consent is free, informed, and given by a person capable of consenting. It can be withdrawn at any time. Minor under 14: the parent or tutor consents. Minor 14 or over: consents alone to care required by their state of health; the parents are informed only if the care involves a stay of more than 12 hours. Incapable adult: mandatary, tutor or curator first; failing that the spouse, then a close relative or a person showing a special interest. Capacity is specific to a decision, not global. A person may be capable of refusing a bath and incapable of consenting to surgery.
